Welcome to Continuum Studios. These Terms of Service ("Terms") govern your access to and use of Continuum Studios (the "Service"), operated by Dragonfish Entertainment LLC, doing business as DRGNFSH ("we," "us," "our," or "DRGNFSH").
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Plain-Language Summary
This is the short version. The full terms below control if there's ever a conflict, but here's the spirit of the agreement:
Your writing is yours. We don't claim ownership of your manuscripts, characters, worlds, or work product. Ever.
We won't train AI on your work. Your manuscripts are never used to train any AI model, ours or anyone else's.
You're paying for a creative tool, not a magic button. Continuum Studios helps you write. It doesn't replace your craft, judgment, or responsibility.
You're responsible for what you create. If you write something illegal or use the tool to harm others, that's on you, not us.
We can change or end the Service. We'll give reasonable notice when we can.
Don't try to break, exploit, or abuse the Service. Account cycling, prompt-injection attacks, scraping our outputs to train other AI, and similar shenanigans will get your account terminated.
If you read nothing else, read that.
2. Who Can Use the Service
Age Requirements
You must be at least 18 years old to create an account or use Continuum Studios. By using the Service, you represent that you are 18 or older.
Some features of the Service support mature creative themes intended for adult writers. The Service is not designed, intended, or appropriate for minors.
Account Eligibility
You may not use the Service if you are:
Located in a jurisdiction where AI services are restricted
Previously suspended or banned from the Service
Acting on behalf of a sanctioned individual, organization, or country
Account Responsibility
You are responsible for:
Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Providing accurate information when signing up
Notifying us promptly if you suspect unauthorized access
You may not share your account with others. Each subscription is for one user.
3. Subscriptions, Billing, and Payment
Subscription Plans
Continuum Studios offers multiple subscription tiers and optional add-ons. Pricing is displayed on our pricing page and is subject to change with 30 days' notice to existing subscribers.
Day Passes
Day Passes are one-time purchases granting limited access for a defined window. They are non-refundable, do not renew automatically, and do not include features reserved for subscribers (such as persistent project memory).
Billing
Subscriptions auto-renew monthly or annually depending on your selected plan
Payments are processed by Stripe; we do not store your full payment card information
You authorize us to charge your payment method at the start of each billing period
Failed payments may result in suspension of access after a reasonable grace period
Cancellations and Refunds
You may cancel your subscription at any time via the Customer Portal
Cancellation takes effect at the end of the current billing period
We do not generally offer refunds for partial months or unused time
Annual subscriptions: If you cancel an annual plan within the first 14 days, you may request a prorated refund by contacting support
Refunds are at our reasonable discretion and not guaranteed except where required by law
Fair Use and Usage Limits
Each subscription tier includes a generous monthly allowance of AI interactions designed to support active, intensive creative work. The vast majority of writers will not approach these limits in normal use.
What counts toward your monthly usage:
Messages sent to the AI (across all projects and add-ons)
Total tokens processed (a measure of conversation length and context size)
Image generation, where applicable to your subscription
Soft limits per tier:

Day Pass
Approximately 200 messages within a 24-hour window
Solo Studio
Approximately 1,500 messages per month
Trio Studio
Approximately 4,000 messages per month
Ensemble Studio
Approximately 7,000 messages per month
Token-based limits also apply and may affect heavy users of large canon documents or extended sessions. Image generation through Art-Unleashed is subject to additional fair-use limits, including a monthly target of 100 image generations.
What happens if you approach your limits:
We will notify you when you reach approximately 80% of your monthly allowance, giving you time to plan, upgrade, or adjust your usage. You will not be cut off without warning.
What happens if you exceed your limits:
If your usage substantially exceeds the allowances above, we may:
Contact you to discuss your usage patterns and recommend a higher tier
Temporarily reduce response speed during peak usage
Offer a custom plan tailored to your actual needs
In extreme cases, suspend access pending discussion
We will not throttle, suspend, or terminate good-faith users without notice. Our goal is to support working writers, not to punish productivity.
What constitutes excessive or abusive usage:
The following patterns indicate misuse rather than heavy use:
Automated, scripted, or bot-driven interactions with the Service
Resale or redistribution of AI responses to third parties
Running the Service in a server, queue, or pipeline capacity rather than for personal creative work
Attempting to extract bulk training data from AI responses
Sustained usage at 10x or more the typical patterns for your tier
Sharing one account across multiple users or teams without an enterprise arrangement
Such patterns may result in immediate suspension, account termination, and forfeiture of unused subscription time, in addition to any other remedies available to us.

Price Changes
We may change pricing at any time. Existing subscribers will be notified at least 30 days before any price change affecting their renewal.
4. Your Content
What "Your Content" Means
"Your Content" includes everything you create, upload, or generate through the Service: manuscripts, characters, worldbuilding, dialogue, prompts, canon documents, session histories, and all creative outputs derived from your use of the Service.
You Own Your Content
You retain all intellectual property rights in Your Content. Nothing in these Terms transfers ownership of Your Content to us.
Limited License to Operate the Service
To provide the Service, you grant us a limited, non-exclusive, royalty-free license to:
Store Your Content on our infrastructure
Process Your Content to deliver AI responses, continuity tracking, and editorial features
Transmit Your Content to third-party AI providers (such as Anthropic) solely to fulfill your requests
This license exists only to operate the Service. It ends when you delete Your Content or terminate your account.
What We Will NOT Do With Your Content
We will not use Your Content to train AI models, ours or anyone else's
We will not sell, license, publish, or share Your Content with third parties (except as required to operate the Service or comply with law)
We will not read, analyze, or review Your Content except as required to provide technical support you request, address security incidents, or comply with legal obligations
We will not use Your Content for marketing, promotion, or advertising without your explicit written consent
Your Responsibility for Your Content
You represent and warrant that:
You have the legal right to upload and use Your Content
Your Content does not infringe on the intellectual property rights of others
Your Content complies with our Acceptable Use Policy (Section 6)
5. AI-Generated Content
Nature of AI Outputs
The Service uses third-party AI models (including but not limited to Anthropic's Claude) to generate responses, suggestions, and creative outputs. AI outputs:
May contain errors, inaccuracies, or unexpected content
Should be reviewed and verified by you before relying on them
Do not constitute professional advice (legal, medical, financial, psychological, or otherwise)
Are creative tools, not authoritative sources
Ownership of AI Outputs
To the extent permitted by law, you own the AI outputs generated in response to your prompts within the Service. We make no claim to ownership of AI-generated text, suggestions, or edits delivered to you.
Limitations of AI
AI models occasionally produce content that is incorrect, biased, contradictory, or not aligned with the user's intent. You acknowledge that:
The Service is a creative assistant, not an editor of record
Final editorial judgment, fact-checking, and creative decisions are yours
We are not liable for decisions you make based on AI outputs
6. Acceptable Use Policy
You agree NOT to use the Service to:
Illegal or Harmful Content
Create content depicting the sexual exploitation or abuse of minors
Plan or facilitate violence against specific real persons
Create content that violates applicable laws in your jurisdiction
Generate malware, phishing material, or content designed to defraud others
Misuse of the Platform
Attempt to extract, reverse-engineer, or reproduce the AI models powering the Service
Use the Service to train, fine-tune, or build competing AI models
Scrape, harvest, or systematically extract outputs from the Service
Use automated tools, bots, or scripts to interact with the Service without our written permission
Circumvent any usage limits, paywalls, or access controls
Create multiple accounts to evade free-tier limits, bans, or pricing tiers
Resell, sublicense, or redistribute access to the Service
Abuse of Other Users or Staff
Harass, threaten, or impersonate others
Submit content that contains personal information about real people without their consent
Use the Service to dox, stalk, or surveil others
Security and Stability
Conduct security testing without prior written authorization
Interfere with or disrupt the Service or its infrastructure
Introduce viruses, malware, or other harmful code
About Mature Creative Content
Continuum Studios supports serious creative writing, including work that explores difficult, dark, violent, or morally complex themes. Mature creative themes in fiction are welcome and protected within the Service.
This does NOT extend to: real-world harm planning, sexual content involving minors, or content created to harass identifiable people. The line between creative exploration and prohibited content is set by harm, not discomfort.
Enforcement
Violations of this Acceptable Use Policy may result in:

Suspension of features
Account termination
Forfeiture of unused subscription time
Reporting to law enforcement where legally required
We reserve sole discretion to determine what constitutes a violation.
Reporting to Authorities
We reserve the right, in our sole discretion, to report user activity to law enforcement or relevant authorities when we reasonably believe such activity:
Involves child sexual abuse material (CSAM), which we are required by U.S. federal law to report to the National Center for Missing & Exploited Children (NCMEC)
Indicates imminent threat of harm to the user or to identifiable third parties
Involves terrorism, mass violence planning, or other serious criminal activity
Is otherwise required to be reported by applicable law
Such reports may include relevant account information, content, and metadata. We will make reports without prior notice to the user when we believe notice would impair an investigation or enable further harm.
7. Service Availability and Changes
No Guaranteed Uptime
We aim to provide reliable access but do not guarantee uninterrupted service. The Service may experience downtime for maintenance, updates, or causes beyond our reasonable control.
Changes to the Service
We may add, modify, or remove features at any time. Material changes affecting paid features will be communicated to subscribers with reasonable notice.
Third-Party Dependencies
The Service depends on third-party providers (including Anthropic, Stripe, Supabase, and Vercel). Outages, changes, or price changes by these providers may affect the Service. We will make reasonable efforts to maintain continuity but cannot guarantee outcomes outside our control.
Beta Features
Some features may be designated as "beta," "preview," or "experimental." These features are provided as-is and may be modified, discontinued, or removed without notice.
8. Intellectual Property of the Service
What We Own
DRGNFSH owns all rights to:
The Continuum Studios name, branding, logo, and visual identity
The Sanctuary Protocol concept and design
The BGN, PRUDENCE.EXE, and Null.Void characters, names, and personalities
The Continuum Studios software, code, design, and infrastructure
The Emotamechs and XBGN Emotamechs brand and characters
All marketing copy, illustrations, and documentation
What You May Not Do
You may not:
Copy, modify, or distribute our branding or characters
Use the names BGN, PRUDENCE.EXE, Null.Void, Sanctuary Protocol, Continuum Studios, DRGNFSH, or Emotamechs in your own products or marketing without written permission
Hold yourself out as affiliated with or endorsed by DRGNFSH without authorization
Feedback
If you send us suggestions, feedback, or ideas, you grant us the right to use them without obligation or compensation.
9. Privacy
Our handling of your personal information is governed by our Privacy Policy, available at ContinuumStudios.ai/privacy. By using the Service, you also agree to the Privacy Policy.
10. Termination
Your Right to Terminate
You may stop using the Service and delete your account at any time. Paid subscriptions can be canceled through the Customer Portal.
Our Right to Terminate
We may suspend or terminate your access, with or without notice, if:
You violate these Terms or the Acceptable Use Policy
Your account is associated with fraudulent activity
Required to do so by law
We discontinue the Service
Effect of Termination
Upon termination:
Your access to the Service ends
Your Content remains accessible to you in read-only mode for 90 days, after which it may be deleted
You may export Your Content at any time before deletion
Outstanding subscription fees remain due
Sections of these Terms that by their nature should survive termination (ownership, disclaimers, limitations of liability) will survive
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, DRGNFSH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
The Service will be uninterrupted, error-free, or secure
AI outputs will be accurate, complete, or appropriate for your purposes
Your data will never be lost, despite our reasonable backup practices
The Service will meet your specific creative or business needs
Responsibility for User-Generated Outputs
The Service responds to user prompts. Users are solely responsible for the prompts they submit and the outputs they generate, store, distribute, or act upon. DRGNFSH does not pre-screen prompts and is not responsible for the consequences of any user's misuse of the Service, including but not limited to: generation of content used to harm others, decisions made based on AI outputs, or distribution of generated content outside the Service.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
DRGNFSH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100 USD, WHICHEVER IS GREATER.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOST CREATIVE WORK.
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY OF THE CLAIM.
Some jurisdictions do not allow these limitations, so they may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless DRGNFSH, its officers, employees, agents, contractors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
Your use or misuse of the Service
Your violation of these Terms
Your violation of any rights of another person or entity
Your Content, including any consequences of its creation, storage, distribution, or use
Any harm you cause to others through the Service, including but not limited to physical, emotional, reputational, or financial harm
Any criminal acts committed using or in connection with the Service
Your violation of any applicable law or regulation
This indemnification obligation survives the termination of these Terms and your use of the Service.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles.
Any dispute arising from these Terms or the Service shall be resolved through:
1. First, good-faith informal negotiation between you and us
2. If unresolved after 30 days, binding arbitration administered under the rules of the American Arbitration Association
3. Arbitration shall take place in Douglas County, Georgia, or by videoconference at the arbitrator's discretion
4. You and DRGNFSH waive the right to a jury trial and to participate in class actions
If arbitration is unenforceable in your jurisdiction, disputes shall be resolved in the state or federal courts located in Douglas County, Georgia.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes:
We will post the updated Terms with a new "Last Updated" date
We will notify active subscribers by email at least 14 days before changes take effect
Continued use of the Service after the effective date constitutes acceptance
If you do not agree to updated Terms, your sole remedy is to stop using the Service and cancel your subscription.
16. Miscellaneous
Entire Agreement
These Terms, together with the Privacy Policy and any policies referenced herein, constitute the entire agreement between you and DRGNFSH regarding the Service.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
Assignment
You may not assign or transfer your rights under these Terms. We may assign our rights to a successor entity (such as in connection with a sale or merger).
Force Majeure
Neither party is liable for failure to perform due to events beyond reasonable control, including natural disasters, war, terrorism, internet outages, or third-party service failures.
